1. Scope

These Terms and Conditions apply to all contracts concluded via talosfamily.de between

– hereinafter referred to as “Provider” or “TalosFamily” –

and its customers regarding the use of the digital services offered by TalosFamily.

These services are primarily intended for consumers as defined in Section 13 of the German Civil Code (BGB).

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial activities nor to their self-employed professional activities.

2. Subject Matter of the Contract

TalosFamily provides customers with a digital networking, filtering, and security service—based on a virtual router and/or a VPN connection—as part of a subscription.

Depending on the plan selected, the service may include the following features in particular:

  • encrypted VPN connection,

  • DNS-based filtering,

  • Protection against known fraudulent or malicious websites,

  • Fraud and Phishing Protection,

  • Features for safe browsing,

  • Ad and tracking blocking,

  • Blocking or restricting social media platforms,

  • Blocking or restricting online gaming services,

  • Blocking of gambling websites,

  • Blocking online casinos and other gambling services,

  • Blocking content not suitable for minors,

  • Additional safety and filtering functions as specified in the respective specifications.

The specific scope of services depends on the plan selected by the customer and the service description published at the time the contract is concluded.

3. Technical Operation and Limitations of Protection

Among other things, the service uses VPN, DNS, firewall, and filtering technologies.

Filtering is performed using technical rules, databases, and automated classifications.

Due to the constantly changing structure and content of the Internet, it is technically impossible to guarantee that every unwanted, fraudulent, harmful, or otherwise objectionable website will be detected and blocked at all times.

Similarly, it cannot be completely ruled out that a website might be temporarily blocked by mistake or assigned to the wrong category.

TalosFamily therefore does not guarantee the complete detection or blocking of all unwanted or harmful content.

The customer's statutory rights in the event of non-conforming performance remain unaffected.

4. Technical Requirements

To use the service, the customer needs a suitable Internet connection as well as compatible devices or appropriate router, operating system, or VPN configurations.

To the extent that TalosFamily provides configuration files, login credentials, installation instructions, or other technical information, these must be used in accordance with the provided instructions.

The customer is responsible for ensuring that their devices and Internet connection meet the specified minimum technical requirements.

5. Conclusion of the Contract

The presentation of the rates on talosfamily.de constitutes an offer to enter into a contract for the respective digital service shown.

The customer selects the desired plan and completes the online ordering process.

Before submitting the order, the customer can review the information entered and correct it if necessary.

By clicking the appropriately labeled order button, the customer submits a binding offer or accepts the corresponding offer.

Once the contract is concluded, the customer will receive an electronic confirmation at the email address they provided.

6. Start of Service

The service is generally provided immediately after the contract is successfully concluded or after the technical setup of access is complete.

If the customer is a consumer and TalosFamily is to begin providing the service before the statutory cancellation period expires, the customer will be asked during the ordering process to expressly request that TalosFamily begin providing the service before the cancellation period expires.

The customer's statutory right of withdrawal remains unaffected.

7. Free Trial Period

7.1 Duration of the Test Phase

If a plan includes a free trial period, it lasts 7 days, unless a different duration is expressly stated in the respective offer.

The free trial period begins upon the conclusion of the contract or upon the provision of the service.

During the free trial period, the customer has access to the features described for the selected plan.

7.2 No subscription fee during the trial period

No regular subscription fee is charged during the 7-day free trial.

The customer can cancel the subscription during the free trial period.

If the cancellation is received in time before the end of the trial period, a paid subscription period will not begin, and no regular subscription fee will be charged.

7.3 Transition to a Paid Subscription

If the subscription is not canceled during the free trial period, the paid subscription period selected when the contract was concluded will automatically begin after the 7-day trial period expires.

As a general rule, the first regular subscription payment is therefore due only after the free trial period has ended.

The applicable price and the billing period are disclosed to the customer before the contract is concluded.

7.4 Trial Period and Statutory Right of Withdrawal

The free trial is an additional, optional service offered by TalosFamily.

It does not replace, shorten, or limit the consumer's statutory right of withdrawal.

In particular, the statutory cancellation period runs independently of the 7-day free trial period.

8. Prices and Payment

The prices listed on the respective product or checkout page at the time of the order apply.

Unless otherwise expressly stated, the prices shown to consumers include all applicable taxes.

Payment is made using the payment methods offered during checkout.

Payments can be processed through Stripe, among other methods.

If a free trial period is offered, the first regular subscription payment will generally not be charged until after the trial period has ended.

9. Contract Term and Automatic Renewal

TalosFamily offers monthly and annual subscriptions in particular.

The applicable minimum term, price, and billing period are disclosed to the customer before the contract is concluded.

Upon expiration of any agreed-upon minimum term, the contract shall be extended solely in accordance with the applicable statutory provisions.

Before the contract is concluded, the customer will be informed of the term and cancellation conditions applicable to the selected plan.

10. Termination for Cause

Regular cancellation of a subscription is distinct from the statutory right of withdrawal.

Termination ends the contract in accordance with the agreed-upon term and termination conditions. It generally does not take effect retroactively and, on its own, does not give rise to any claim for reimbursement of fees that have already been properly incurred.

10.1 Cancellation During the Free Trial Period

If the customer cancels during the 7-day free trial period in a timely manner before it expires, the subscription will not continue as a paid subscription.

In this case, no regular subscription fee will be charged.

10.2 Termination After the Start of the Paid Period

If notice of termination is given after the start of the paid subscription period, the contract will end in accordance with the termination terms applicable to the respective plan.

A subscription fee that has already been properly charged will generally not be refunded solely on the basis of a regular termination, unless mandatory law provides otherwise.

The customer's statutory right of withdrawal and other mandatory statutory rights remain unaffected.

10.3 Option to Cancel on the Website

To the extent required by law, TalosFamily provides an electronic cancellation feature on its website that is immediately and easily accessible.

In addition, notice of termination may be given in writing, specifically by email to:

support@talosfamily.de

The statutory right to terminate the employment contract for cause remains unaffected.

11. Statutory Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal provided the legal requirements are met.

The statutory cancellation period is generally 14 days.

Further details are provided in TalosFamily’s separate cancellation policy, which is made available to the customer before or upon conclusion of the contract.

11.1 Relationship Between the Trial Period and Cancellation

The optional 7-day free trial and the statutory right of withdrawal are independent of one another.

For example, a customer can take advantage of the free trial and cancel the subscription within the first 7 days without incurring a regular subscription fee.

If the subscription is not canceled during the trial period, the agreed-upon paid subscription period may begin on the 8th day.

Any statutory right of withdrawal that may still apply remains unaffected.

11.2 Cancellation After the Start of the Paid Subscription Period

If a consumer effectively exercises their statutory right of cancellation after the paid subscription period has already begun, payments made under the canceled contract will be refunded in accordance with the statutory provisions.

Provided that the legal requirements are met, TalosFamily may demand reasonable compensation for paid services that have already been provided up to the time of cancellation.

11.3 Compensation for Services Rendered Prior to Cancellation

TalosFamily is entitled to compensation for services rendered up to the time of cancellation only if the legal requirements for such compensation are met.

This includes, in particular, that the consumer has expressly requested that TalosFamily begin providing the service before the expiration of the cancellation period, and that the consumer has been properly informed of his or her right of cancellation as well as any potential obligation to compensate for lost value.

The refund will be calculated on a pro rata basis based on the scope of the chargeable services actually provided up to the time of cancellation.

No regular subscription fee will be charged for periods that were explicitly offered as a free trial.

11.4 Difference Between Termination and Rescission

A termination with notice is not the same as a revocation.

If the customer simply states that they wish to cancel, this is generally treated as termination of the subscription in accordance with the applicable cancellation terms.

If, on the other hand, the consumer clearly states within the statutory cancellation period that he or she wishes to cancel the contract, the statement will be handled in accordance with the statutory cancellation provisions.

12. Provision of the Service

The digital service will be provided once the contract has been successfully concluded or the customer account has been successfully set up.

If configuration files, login credentials, or other technical settings are required, they can be provided electronically.

13. Login Information and Security

The customer is required to protect login credentials, configuration files, and other security-related information from access by unauthorized third parties.

Personal login credentials must not be disclosed to unauthorized third parties.

If there is any suspicion that login credentials have been compromised, the customer should notify TalosFamily immediately.

14. Customer Obligations

The customer may use the service only in accordance with applicable law.

In particular, the service may not be used for illegal activities, attacks on third-party computer systems, the distribution of malware, fraud, identity theft, or similar abusive purposes.

15. Account Suspension for Misuse

If there is concrete evidence of a significant misuse of the service that is unlawful or in breach of the contract, TalosFamily may temporarily restrict or suspend access, provided that this is reasonable in light of the interests of both parties.

The right to terminate the contract for cause remains unaffected.

16. Availability

TalosFamily strives to ensure high service availability.

However, uninterrupted availability at all times cannot be guaranteed, particularly due to maintenance work, security measures, technical malfunctions, outages of third-party infrastructure, or circumstances beyond TalosFamily’s control.

The customer's statutory rights in the event of non-conforming performance remain unaffected.

17. Updates and Security Updates

During the applicable service period, TalosFamily will provide the necessary updates, including security updates, to ensure that the digital service remains in compliance with the terms of the contract.

If an update requires action on the part of the customer, the customer will be notified accordingly.

18. Changes to the Service

TalosFamily may further develop and modify its technical systems, filter databases, security features, and infrastructure to the extent permitted by law.

A valid reason for changes may arise, in particular, due to:

  • new security threats,

  • technological developments,

  • Changes to technical standards,

  • Safety or stability requirements,

  • legal or regulatory requirements,

  • Changes to services provided by external infrastructure providers.

The customer's mandatory statutory rights regarding information, notice of termination, or termination remain unaffected.

19. Filtering and Incorrect Classifications

Websites can be automatically assigned to categories.

New domains, subdomains, dynamic services, or updated websites may not yet have been included or may temporarily be assigned to the wrong category.

Just because a website isn't blocked doesn't mean that TalosFamily considers it safe, legitimate, or recommended.

Conversely, blocking a website does not necessarily mean that the website or its operator is acting unlawfully.

20. No Guarantee of Complete Security

TalosFamily provides an additional technical security measure.

This service does not replace the responsible use of the Internet, up-to-date operating systems, strong passwords, security software, and other appropriate security measures.

No technical protection system can detect or prevent all phishing attacks, fraud attempts, malware, or other cyber threats.

The customer's statutory rights in the event of defective performance or performance not in accordance with the contract remain unaffected.

21. Rights Related to Digital Products

The mandatory statutory provisions governing digital products and digital services apply, in particular Sections 327 et seq. of the German Civil Code (BGB).

Provided that the legal requirements are met, consumers are entitled, in particular, to have the digital service brought into conformity with the contract, as well as to other legal remedies.

22. Liability

TalosFamily has unlimited liability:

  • in cases of willful misconduct and gross negligence,

  • for damages resulting from injury to life, body, or health,

  • to the extent that mandatory statutory liability applies,

  • to the extent that TalosFamily has expressly provided a warranty.

In the event of a breach of a material contractual obligation due to slight negligence, liability is limited to the damages that were foreseeable at the time the contract was concluded and that are typical for this type of contract.

Furthermore, liability for damages caused by slight negligence is excluded to the extent permitted by law.

Mandatory statutory consumer rights remain unaffected.

23. Third-Party Providers

TalosFamily may use third-party providers to deliver its services, particularly for hosting, network infrastructure, and payment processing.

This may include, in particular, Stripe for payment processing.

24. Data Protection

Information regarding the processing of personal data can be found in the current privacy policy on talosfamily.de.

25. Consumer Dispute Resolution

Unless TalosFamily is legally required to participate or has otherwise committed to doing so, TalosFamily is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Mandatory legal disclosure requirements remain unaffected.

26. Governing Law

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded to them by mandatory provisions of the law of the country in which they habitually reside.

27. Final Provisions

Should any provision of these General Terms and Conditions be or become invalid, in whole or in part, the validity of the remaining statutory and contractual provisions shall remain unaffected.

Any invalid provision shall be replaced by the applicable statutory provisions.
